Police: Son Tries to Throw Father From Second-Floor Porch

An argument in which a father told his 30-year-old son to move out of their East Avenue home turned violent, and during a scuffle the son tried to throw his father from a second-floor porch, police said.

The son also pushed his girlfriend, 26, to the floor, and she had red marks on her neck, police said.

New Canaan police gave this account (accusations not proven in court) of the matter:

Patrick Smith, 30, of East Avenue was arguing with his father, 52, on the morning of Dec. 31 when the dispute turned violent with a scuffle. Although Smith didn’t throw a punch at anyone, he grabbed his father by his shirt and ripped it as they leaned against the second-story railing of the porch.

He also threw his father to the floor. The father had minor cuts on his right arm and red marks on his chest, back and neck.

Smith also grabbed his and threw her to the floor. She had red marks on her neck.

The only punches he threw were against a wall, several times.

His father told him to move out by the end of the day. He left the home.

Police, called at 11:21 a.m., found Smith nearby on Burdis Avenue. He admitted to grabbing his girlfriend and throwing her to the floor. He said he didn’t hurt his father.

Smith was charged with two counts of third-degree assault, disorderly conduct, second-degree breach of peace and third-degree criminal mischief. His bond was set at $10,000, which he did not post, and he stayed in jail for two nights before appearing Jan. 2 in state Superior Court in Norwalk.

As of Wednesday, he was still in custody according to the Connecticut Judicial Branch website, but his bond for this case had been lowered to $2,500. His next court date is Jan. 21.
