New Milford Health Panel Approves Well Variances For Mist Hill, Candlewood Lake Road Properties
New Milford's Health Review Panel approved well variances for properties on Mist Hill Drive and Candlewood Lake Road North.
NEW MILFORD, CT — The New Milford Health Review Panel unanimously approved well-related variances for properties on Mist Hill Drive and Candlewood Lake Road North during a brief Aug. 12 meeting.
Wetlands Enforcement Officer James Ferlow and Zoning Enforcement Officer Laura Regan attended the meeting, which began at 3 p.m. and lasted nine minutes.
Variances approved for 47 Mist Hill Drive
The panel first considered a well drilling permit for 47 Mist Hill Drive, a vacant property with an approved site plan for construction, according to information provided by the Housatonic Valley Health District.

The Health Department provided property address information and a well request, but the panel had not received a survey for the property.
The proposed well's protected radius would extend onto two neighboring properties.

At 63 Mist Hill Road, owned by Helen and Jane Zekala, the proposed well would be 18 feet from the property line. Because 75 feet is required for the protected well radius, the proposal required a 32-foot variance.
At 49 Mist Hill Road, owned by Andrew and Corey Conserva, the proposed well would be 22 feet from the property line and require a 28-foot variance from the 75-foot requirement.
According to the meeting minutes, the narrow, preexisting lot and subdivision leave no alternative location for the well that would not substantially affect neighboring properties. The minutes also state that the proposed well's radius would overlap with the well radius at 63 Mist Hill Road and that the two would help protect each other.
The panel unanimously approved the well exceptions with the specified variances. Regan seconded the motion.
Candlewood Lake Road well exemptions approved
The panel also unanimously approved well exemptions for 92 Candlewood Lake Road North.
Additional information submitted to the panel clarified that 92 Candlewood Lake Road North is the correct address for the property. The minutes state that an earlier reference to 90 Candlewood Lake Road North, the site's former address, may have resulted from a scrivener's error.
The application sought exemptions from 25-foot well radius requirements affecting two neighboring properties.
A 22-foot variance was required along the property to the north, identified in the minutes as the former site of Walther Quizhipi. That property is outside the well radius and sanitary septic requirements, according to the panel.
Another 22-foot exemption was required for property belonging to Connecticut Light and Power. The minutes state that the utility property is not to be developed and contains power lines.
Ferlow moved to approve the well exemption for 92 Candlewood Lake Road North with the specified variances. Regan seconded the motion, which passed unanimously.
No other comments or discussions were recorded. The meeting ended at 3:09 p.m.
