Norwalk Man Wins Jury Trial In Oxycodone Possession Case: Report

The successful defense had not been used in Connecticut, according to the defendant's attorney.

NORWALK, CT — An attorney for Norwalk resident Omari Caldwell, who was arrested on narcotics possession charges in 2013, argued in court that he had a legal right to hold oxycodone for his grandfather. And a jury this week agreed, finding Caldwell not guilty which could have significant ramifications in the state, reports The Hour.

Caldwell's attorney, Darnell Crosland, of Stamford, convinced the jury that Caldwell was in essence the "ultimate user" of the drug because he had it in his possession for his grandfather, who was prescribed the drug because he had had dental surgery a few days before the arrest.

The state statute Crosland used to mount the defense was 21a-240, which Crosland says allows for people to hold legal prescriptions for family members. Such a defense had not been used in Connecticut, he told the publication.
