A developer is allowed to bypass local zoning laws when filing an affordable housing application if 10 percent of a community's housing stock isn't considered affordable, according to state guidelines. A community can deny affordable housing projects but the developer often takes the municipality to court, almost always wins, and the community is forced to pay the legal fees.
