Defiant Motorcycle Ride In Tolland Leads To Probation Violation Charge

TOLLAND, CT — A Tolland man who was convicted of several crimes and ordered to drive under tight restrictions as part of his sentencing is now facing a charge of probation violation after defying state police on a speeding motorcycle, a warrant shows.

A warrant was served to 24-year-old Devin Marsh last week. He entered a guilty plea to a driving while under suspension charge and is being held on a $10,000 bond for the probation violation charge, judicial system records show. His initial bond in the case was $50,000.

Marsh's case dates back to March 7, 2022, when he appeared before Judge Kathleen McNamara in Rockville Superior Court and sentenced to terms for several transgressions.

They include:

• For possession of a controlled substance and driving while under suspension for alcohol, he received 364 days in jail, suspended after four months, with three years of probation.
• For DUI, he was sentenced to six months in jail, suspended after two days, with 18 months of probation, to run concurrently with the 364 days.
• He received another 364 days for a driving under suspension charge, suspended after 4 months with three years of probation, running consecutively with the previous sentences.
• Another 364 consecutive days were added for a charge of engaging police in a pursuit, suspended after two months with three years of probation.
• He also received a concurrent sixth-month sentence, suspended after two days, with 18 months of probation, for a DUI charge.

The latest guilty plea for drunken while under suspension was from July 13, when Marsh passed a state police cruiser on a motorcycle at a high rate of speed. A trooper caught up with Marsh, but he shook his head at the trooper to indicate "no," and sped away, according to a warrant. Marsh was then tracked down at an area campground, where he works, and state police located the motorcycle hidden under a black tarp on the property, according to a warrant.

He was then slapped with the probation violation charge in addition to the motor vehicle suspension charge, state police said.

His probation conditions included:

• Not breaking any law
• Not driving while under suspension
• Using an interlocking ignition device after the suspension
