Because Margelony is on parole, police were required to arrest him, a department spokesman said.

Court records show he was convicted in October 2016 of first-degree larceny and had a five-year sentence suspended. The sentence was reinstated a year later, suspended after six months with three years probation, because of a probation violation, court records show. Court records also show he was sentenced to 30 days in jail with a year's probation in July 2016 for sixth-degree larceny.

He was charged locally on Wednesday with sixth-degree larceny, police said. The energy drink cost $2.79 and was $3.02 after tax, according to an incident report.
