One Option Off the Table in Oakdale-Wallingford Dispute

Wallingford's Corporation Counsel advises the Town Council on Live Nation's request for a noise ordinance exception for the Oakdale.

One potential option for helping to bring a resolution to the dispute between the Toyota Oakdale Theatre and the town of Wallingford is off the table.

The Meriden Record-Journal reports that Corporation Counsel Janis Small has notified the Town Council that it is not allowed to grant Live Nation Worldwide Inc. a limited exemption to the town’s noise ordinance for the Oakdale because it would exceed the state law.

Joan Malloy, the attorney representing Live Nation, had requested an increase in the decibel level in town’s noise ordinance or a limited exception for the Oakdale.

The town’s noise ordinance for commercial zones is the same as the state’s regulations and Small told the Record-Journal that the town’s ordinance can be “more restrictive” than state law, but not less restrictive.

Both sides say they are continuing to work on a resolution to the cease-and-desist order.
