Wallingford Man Receives $4.25 Million in Medical Malpractice Lawsuit

The man sued a MidState Medical doctor for a 2008 surgery that left him with permanent nerve damage in his left shoulder.

Wallingford’s Gregory Leigh, 58, was awarded $4.25 million Wednesday by a Superior Court jury in New Haven in a malpractice lawsuit against a MidState Medical doctor after surgery left him with permanent nerve damage in his left shoulder.

The Meriden Record-Journal reports that in 2008, Leigh went to MidState Medical Center for treatment of a mass in his neck and suffered permanent nerve damage during a surgical procedure that was later determined to be performed unnecessarily.

One of Leigh’s attorneys told Luther Turmelle of the New Haven Register that a simple test would have shown that Leigh was actually suffering from a mild Bartonellosis bacterial infection, also known as “cat scratch disease.”

Dr. Daniel Schwartz, who performed the 2008 surgery, and MidState Medical Group were named as codefendants in the lawsuit.
