Update: Family Sues Wilton Board of Ed Over Alleged Sex Assault

The alleged abuser was sentenced in October for possessing child pornography. The suit claims he sexually assaulted a 4-year-old.

A local family is suing the Wilton Board of Education and town alleging that a former paraprofessional who was found guilty of possessing child pornography also sexually assaulted a 4-year-old student.

The alleged incident happened in January 2013, according to the lawsuit filed by Stamford law firm Silver Golub & Teltell LLP.

The suit alleges that Eric von Kohorn, “inappropriately touched, sexually assaulted and battered” a four-year-old Miller-Driscoll School preschool student during the school day in a bathroom.

The incident left the girl with a visible injury to her genital area. The girl told her mother that Von Kohorn wiped her too hard.

Von Kohorn was found guilty of possessing child pornography and was sentenced on Oct. 23 to six years in jail suspended after two years. He was also given 10 years of probation.

Von Kohorn’s lawyer Jason Sheffield said that they worked with police and the school system to demonstrate that Von Kohorn wasn’t a child predator and never committed hands-on offenses, according to the Wilton Bulletin.

The allegations in the suit were previously aired and Superintendent Kevin Smith said in August 2014 that Von Kohorn didn’t inappropriately touch students, according to a NBC Connecticut report. Smith couldn’t be reached immediately for comment Thursday.

The suit goes on to allege that Principal Fred Rapczynski violated a legal obligation to report the allegation within 12 hours to the Department of Children and Families and instead waited four days. It also states that Rapczynski informed the girl’s parents that his investigation found Von Kohorn didn’t take the girl into the bathroom, but in a report to DCF he said von Kohorn admitted to taking the girl into the bathroom.

At least one other staff member knew Von Kohorn took the girl into the bathroom alone, but didn’t take steps to prevent him from doing so, according to the lawsuit.
