Lawsuit Filed Against Driver After Lakeland Amtrak Derailment: Report
Three trucking companies are also named in the lawsuit, filed days after an Amtrak train crashed into a tractor-trailer, injuring eight.
LAKELAND, FL — Nearly a week after an Amtrak train crashed into a tractor-trailer at a Lakeland rail crossing, a lawsuit was filed accusing the semi driver and three trucking companies of negligence, according to a report.
The lawsuit was filed against Lastre Auto Transport, M & L Auto Transport and Betan Auto Transport, WFLA reported. The suit also claims the driver, who was transporting cars for the three companies, did not operate the truck in a "reasonably safe manner," the report said.
"The catastrophic derailment caused by the alleged negligence of the driver not only injured dozens of people but also disrupted train service for thousands of customers and caused massive delays," attorneys for the plaintiffs wrote in the lawsuit. "We’re committed to holding those responsible accountable for their actions and omissions that led to this incident."

According to the Polk County Sheriff's Office, the crash happened shortly after 7 p.m. on July 14 on Canal Avenue North, just south of U.S. Highway 92. Authorities said prior to the crash, a truck hauling seven vehicles on a trailer became stuck on the tracks.

According to authorities, the truck was hit by an Amtrak train that had left the Lakeland station. Police said the train was carrying 163 passengers and 10 crew members.
As the train approached the crossing, police said the engineer saw the truck and blew the train's horn; however, as the crossing arms and lights activated, the driver and passenger both jumped out of the truck.
After hitting the truck, police said the train traveled another 200 yards before coming to a stop. The crash caused a portion of the lead engine to derail and leak a small amount of diesel fuel.
According to authorities, eight people received treatment at local hospitals for minor injuries.
According to the lawsuit, 14 people listed as plaintiffs are seeking monetary damages in excess of $50,000, according to the lawsuit. It's unclear if the plaintiffs were passengers on the train.
