PODS® Enterprises wins lawsuit against U-Haul for trademark infringement

(CLEARWATER, Fla.) — August 28, 2015 — PODS Enterprises, LLC prevailed in its lawsuit against U-Haul International, Inc. this week after a lengthy battle over the use of the PODS trademark.
Last September, a jury found U-Haul liable for federal and state trademark infringement of the famous PODS trademark, as well as federal and state trademark dilution, unfair competition and deceptive trade practices. The jury awarded PODS $60.7 million in damages. U-Haul filed post-trial motions challenging the jury’s verdict on various grounds, and the U.S. District Court has now denied all of U-Haul’s motions. In addition to denying U-Haul’s motions and reaffirming the verdict, the court awarded PODS over $4.9 million in pre-judgment interest, which brings the final judgment to $65,636,100 plus PODS’ costs. The court also issued a permanent injunction against U-Haul to respect the validity of the PODS trademark.
