Greenlight - The 50 Year Mortgage

Below are two lengthy Sections from the Interlocal Agreement between PSTA and Pinellas County that was approved at the June PSTA Board of Directors meeting.

SECTIONΒ  7.Β  PLEDGE OF SURTAX NET PROCEEDS.

This Section provides the authority for the PSTA to obligate sales tax proceeds to the payment of bonds issued by PSTA. Once obligated, these funds cannot be reduced or used for any other purpose by PSTA or the County. The bond covenants will determine how the money is to be spent, and while the County may have some say in the structuring of the bonds, PSTA will really be in the driver's seat, because they will actually be spending the bond proceeds with limited County over sight.

We have already seen how liberally PSTA interprets rules related to spending money.

SECTIONΒ  9.Β  REDUCTION AND TERMINATION OF SURTAX.

Upon the earlier of:

(A)Β  completionΒ  ofΒ  allΒ  stepsΒ  toΒ  financeΒ  (includingΒ  withoutΒ  limitationΒ  debtΒ  incurrence,Β  and/orΒ  executionΒ  ofΒ  public-privateΒ  partnershipsΒ  orΒ  leases), acquire,Β  and/orΒ  constructΒ  allΒ  projectsΒ  andΒ  capitalΒ  improvementsΒ  contemplatedΒ  inΒ  PSTA'sΒ  GreenlightΒ  Plan,Β  asΒ  mutuallyΒ  determinedΒ  byΒ  PSTAΒ  andΒ  theΒ  CountyΒ  (ifΒ  theΒ  partiesΒ  cannotΒ  mutuallyΒ  determineΒ  whetherΒ  PSTA'sΒ  GreenlightΒ  PlanΒ  hasΒ  beenΒ  completed,Β  the Β partiesΒ  shallΒ  engageΒ  aΒ  nationallyΒ  recognizedΒ  transitΒ  consultantΒ  acceptableΒ  toΒ  bothΒ  PartiesΒ  toΒ  makeΒ  suchΒ  determination);

(B)Β  PSTA'sΒ  decisionΒ  toΒ  discontinueΒ  suchΒ  stepsΒ  toΒ  finance,Β  acquireΒ  and/orΒ  constructΒ  substantiallyΒ  allΒ  ofΒ  theΒ  projectsΒ  andΒ  capitalΒ  improvementsΒ  contemplated Β inΒ  PSTA'sΒ  GreenlightΒ  Plan

(C)Β  the occurrenceΒ  ofΒ  aΒ  ForceΒ  Majeure

(D)Β  theΒ  fiftiethΒ  50thΒ  anniversaryΒ  ofΒ  theΒ  dateΒ  theΒ  SurtaxΒ  isΒ  firstΒ  leviedΒ  andΒ  eachΒ  20thΒ  anniversaryΒ  thereafter;

(E)Β  a paymentΒ  defaultΒ  underΒ  theΒ  TrustΒ  Agreement;Β  or

(F)Β  PSTAΒ  applyingΒ  SurtaxΒ  NetΒ  ProceedsΒ  forΒ  aΒ  purposeΒ  otherΒ  thanΒ  PSTA'sΒ  GreenlightΒ  Plan,

theΒ  CountyΒ  andΒ  PSTAΒ  shallΒ  meetΒ  toΒ  discussΒ  theΒ  particularΒ  eventΒ  describedΒ  inΒ  clauses Β (A)Β  throughΒ  (F)Β  thatΒ  hasΒ  occurredΒ  andΒ  shallΒ  consider,Β  dependingΒ  uponΒ  theΒ  event,Β  revisingΒ  thisΒ  Agreement,Β  revisingΒ  orΒ  addingΒ  toΒ  PSTA'sΒ  GreenlightΒ  Plan,Β  seekingΒ  furtherΒ  authorizationΒ  forΒ  additionalΒ  usesΒ  byΒ  PSTAΒ  ofΒ  theΒ  SurtaxΒ  NetΒ  ProceedsΒ  orΒ  reducingΒ  orΒ  increasing,Β  ifΒ  thereΒ  hasΒ  beenΒ  aΒ  previousΒ  reductionΒ  andΒ  subjectΒ  toΒ  theΒ  limitationsΒ  ofΒ  theΒ  SurtaxΒ  Referendum,Β  temporarilyΒ  orΒ  permanently,Β  theΒ  SurtaxΒ  NetΒ  Proceeds.Β  IfΒ  theΒ  PartiesΒ  areΒ  unableΒ  toΒ  agreeΒ  onΒ  whatΒ  action,Β  ifΒ  any,Β  toΒ  take,Β  afterΒ  makingΒ  aΒ  goodΒ  faithΒ  effort,Β  theΒ  CountyΒ  mayΒ  takeΒ  anyΒ  legallyΒ  requiredΒ  actionΒ  toΒ  reduceΒ  theΒ  SurtaxΒ  NetΒ  ProceedsΒ  distributedΒ  toΒ  PSTA.Β  InΒ  determiningΒ  whatΒ  actionΒ  toΒ  take,Β  ifΒ  any,Β  pursuantΒ  toΒ  thisΒ  SectionΒ  9,Β  theΒ  PartiesΒ  shallΒ  complyΒ  withΒ  theΒ  provisionsΒ  ofΒ  SectionΒ  29(B)Β  hereof.

AnyΒ  reductionΒ  ofΒ  SurtaxΒ  NetΒ  ProceedsΒ  distributedΒ  toΒ  PSTAΒ  asΒ  aΒ  resultΒ  ofΒ  anΒ  actionΒ  orΒ  eventΒ  describedΒ  inΒ  clausesΒ  (C),Β  (E)Β  orΒ  (F)Β  aboveΒ  shallΒ  beΒ  temporaryΒ  andΒ  theΒ  CountyΒ  shallΒ  promptlyΒ  beginΒ  distributingΒ  theΒ  fullΒ  amountΒ  ofΒ  theΒ  SurtaxΒ  NetΒ  ProceedsΒ  toΒ  PSTA,Β  includingΒ  allΒ  amountsΒ  thatΒ  wereΒ  heldΒ  backΒ  andΒ  actualΒ  interestΒ  earnings,Β  ifΒ  any,Β  actuallyΒ  derivedΒ  byΒ  theΒ  County,Β  whenΒ  theΒ  CountyΒ  determines,Β  in itsΒ  soleΒ  discretion,Β  thatΒ  suchΒ  eventΒ  orΒ  actionΒ  hasΒ  beenΒ  curedΒ  orΒ  noΒ  longerΒ  exists.Β  TheΒ  foregoingΒ  shallΒ  notΒ  imposeΒ  aΒ  dutyΒ  onΒ  theΒ  CountyΒ  toΒ  investΒ  anyΒ  ofΒ  suchΒ  withheldΒ  amounts.Β  TheΒ  CountyΒ  shallΒ  determine,Β  in itsΒ  soleΒ  discretion,Β  whetherΒ  anyΒ  reductionΒ  ofΒ  SurtaxΒ  NetΒ  ProceedsΒ  distributedΒ  toΒ  PSTAΒ  asΒ  aΒ  resultΒ  ofΒ  anΒ  actionΒ  orΒ  eventΒ  describedΒ  inΒ  clausesΒ  6Β  (A),Β  (B)Β  orΒ  (D)Β  willΒ  beΒ  temporaryΒ  orΒ  permanent.Β  IfΒ  theΒ  CountyΒ  determinesΒ  toΒ  permanentlyΒ  reduceΒ  theΒ  distributionΒ  ofΒ  theΒ  SurtaxΒ  NetΒ  Proceeds,Β  toΒ  theΒ  extentΒ  andΒ  asΒ  permittedΒ  byΒ  law,Β  itΒ  mayΒ  takeΒ  suchΒ  actionΒ  asΒ  itΒ  deemsΒ  necessaryΒ  andΒ  isΒ  legallyΒ  requiredΒ  toΒ  reduceΒ  theΒ  amountΒ  ofΒ  theΒ  SurtaxΒ  levyΒ  inΒ  accordanceΒ  withΒ  thisΒ  Section.Β  NotwithstandingΒ  anythingΒ  inΒ  thisΒ  SectionΒ  9Β  toΒ  theΒ  contrary,Β  anyΒ  temporaryΒ  reductionΒ  shallΒ  beΒ  limitedΒ  toΒ  anΒ  amountΒ  thatΒ  willΒ  notΒ  impairΒ  PSTA'sΒ  abilityΒ  toΒ  meetΒ  allΒ  ofΒ  itsΒ  thenΒ  outstandingΒ  financialΒ  obligationsΒ  underΒ  theΒ  TrustΒ  Agreement.

This Section sets up the conditions under which the sales tax would terminate. Note that (D) sets the life expectancy of Greenlight at 50 years but allows for two 20 year extensions.

That's 90 Years!

TWO generations.

A baby born on January 1, 2015 when this Tax starts, will pay the tax their entire life, their children will pay it and it is not inconceivable their grand children may also pay it.

This amount of indebtedness for this length of time to develop 24 four rail stations for a train generally going to the wrong places; buying and selling a bunch of land and building tracks and buildings so a very few can get very rich is very, very wrong.

The law you are being asked to approve with your YES vote is just over 5000 words long. The Interlocal Agreement where the County attempts to put some control on PSTA is over 7000 words long. And we have just begun.

Don't mortgage your future, your children's future and grandchildren's future for a train that does not meet the core public transportation need and will cost millions more than the Greenlight plan contemplates.

Send the County, PSTA, TBARTA and Greenlight back to drawing board just like they did in Hillsborough County.

Greenlight is a plan that we don't need and cannot afford.
