West Palm Beach Wins Legal Fight Over Okeechobee District

The mayor says the order provides further evidence that the city took all the necessary steps to properly establish the business district.

The Fourth District Court of Appeal affirmed a lower court opinion upholding the City of West Palm Beachโ€™s creation of the Okeechobee Business District. The order entered on May 28, 2020 is now final. The Town of Palm Beach and 222 Lakeview had appealed a judgeโ€™s ruling that the petitioners did not prove beyond fair debate the Cityโ€™s comprehensive plan amendment creating the Okeechobee Business District in the Downtown Master Plan Element was not โ€œin compliance,โ€ under section 163.3185.
