Phipps Plaza, Lenox Square Allege Restaurants Violated their Leases
The alleged violations occurred during a 2012 divorce settlement between the restaurants' owner and his wife, a lawsuit claims.

The lessors at two Buckhead shopping destinations are seeking to evict two restaurants which they claim breached their lease agreements, the Atlanta Journal-Constitution reports.
According to the AJC, CPI Phipps and The Retail Property Trust have sued Atlanta chef Tom Catherall, his wife, and companies they own, including Here to Serve Restaurants, Inc. Here to Serve owns and operates Twist restaurant at Phipps Plaza and Prime restaurant at Lenox Square, the AJC writes.
The lawsuit claims that during the Catherall’s 2012 divorce, the ownership of Here to Serve was given to Catherall’s wife, and the leases of the two Buckhead restaurants were put in her name without the knowledge of the lessors.

CPI Phipps and The Retail Property Trust are seeking monetary damages and the removal of Twist and Prime from the two malls, according to the AJC.
