The accident occurred around 10:30 p.m. Sept. 24 along S.R. 3/U.S. 41 (Joe Frank Harris Parkway) south of Oak Hill Circle near the former Georgia State Patrol post.
The state agency said the pedestrian, Rebecca Jacks, 36, of Cartersville, was “walking in the roadway with the flow of southbound traffic in the right lane” when a Kia Optima traveling in the same direction hit Jacks.

“Due to the darkness and heavy rainfall at the time, the driver stated they could not see Miss Jacks walking in the road until it was too late to avoid her,” Trooper Dillon Graves said.
Jacks, who was alert and talking while on the scene, was transported to WellStar Kennestone Hospital where she was treated for non life-threatening injuries. She did, however, have a broken neck, Graves stated.
