Trial of Alleged Penske Shooter to Begin in May

Despite pleas from his lawyers to stop his death penalty case, the man accused of shooting five people at the Hertz Penske Truck Rental facility in Kennesaw more than three years ago will go to trial in May.

One of the two people to survive the shooting was Cartersville resident Joshua Holbrook, then 27, a Cobb County native who worked as a mechanic and lived in Bartow with his wife and two small children.

Lawyers for Jesse James Warren filed motions Monday in which they argued Warren was insane at the time of the shootings and is mentally incompetent to stand trial now, according to WSB-TV.

However, Cobb County Judge Mary Staley set a May 28 trial date, the Atlanta Journal-Constitution reported.

Warren, who worked as a truck mechanic for Penske from June 2005 until July 2009, allegedly opened fire inside the facility just before 2 p.m. on Jan. 12, 2010, according to the AJC.

Jaider Felipe Marulanda, 43, of Lawrenceville; Roberto Gonzalez, 31, of Dallas; and Van Springer, 59, of Woodstock, were killed in the shootings.

In addition to Holbrook, Zachariah Werner was critically injured, according to the Marietta Daily Journal. Werner, who was left with a bullet lodged in his brain stem and unable to function normally, filed a $20 million suit against business related to the Penske facility and Warren. Holbrook and the widows of two of the men who died in the shooting also have filed suit.
