Cobb Student Recorded Sex Act, Faces Felony: Police

The 17 year old used his cellphone to record two fellow students in a bathroom stall, then shared the video online, police say.

KENNESAW, GA — A 17-year-old Cobb County student is facing felony eavesdropping charges after police say he used his cellphone to record video of two younger students performing a sex act at school.

Steven Bahner, a student at Harrison High School in Kennesaw, is charged with felony eavesdropping and surveillance, according to his arrest warrant. The warrant says Bahner was in a restroom when he reached over the top of a stall and recorded a 15-year-old girl performing a sex act on a 16-year-old boy.

The bathroom stall was closed at the time, the students weren't aware they were being recorded and the act was consensual, according to Cobb County Police. Bahner later shared the video online and it spread on social media, in group chats and elsewhere, it says.

An assistant principal discovered the video online last week and contacted police. According to his warrant, Bahner claimed that he took the video because he was shocked the school could allow a sex act to take place on campus.

Bahner was booked at Cobb County Jail, where he was released on bond Thursday morning.

In an email on Wednesday, a Cobb County schools spokesman told Patch that the incident "has been thoroughly investigated by school administrators and school district police."

"In addition to the criminal charge, appropriate action has been taken in accordance with the Student Code of Conduct," the email said.
