Alabama Judge Arrested in Atlanta Could Avoid Trial
U.S. District Judge Mark Fuller could escape prosecution by entering a treatment program recognized as a pre-trial intervention measure.

A federal district judge who allegedly assaulted his wife in the Ritz-Carlton Hotel in Atlanta could avoid a trial, reports WSB-TV.
Mark Fuller has allegedly entered an unspecified treatment program stemming from his arrest on the evening of Aug. 9. Police said that Fuller’s wife accused him of assaulting her. She was treated by paramedics at the scene but refused to go to the hospital.
Fulton County, where the offense allegedly occurs, offers pre-trial intervention and diversion programs for some defendants which allows them to avoid prosecution for their crimes. Fuller’s treatment program may be once recognized by the court for this purpose.

Judge Fuller presided over the bribery trial of former Alabama Gov. Don Siegelman and HealthSouth CEO Richard Scrushy. Siegelman was convicted and sentenced to seven years in prison in 2006.
