Atlanta Sperm Bank Sued For False Advertising

The lawsuit alleges that the sperm provided by the bank belonged to a mentally ill college dropout who had been arrested in the past.

An Ontario couple is suing a sperm bank with a branch in Atlanta after they discovered the biological father of their child was not who the sperm bank said he was.

According to the lawsuit quoted by the Atlanta Journal-Constitution, Angela Collins and Margaret Elizabeth Hanson were told by Augusta-based Xytex Corp. that the sperm used for their intra-uterine insemination was donated by a man with an IQ of 160 who was working on a PhD. The donor’s name was not given, a standard practice to ensure anonymity.

After Xytex inadvertently revealed the identity of the donor via e-mail, Collins and Hanson did some research on the father of their child and learned he is schizophrenic and has been arrested for burglary in Cobb County, the lawsuit claims. Additonally, the AJC reports, the lawsuit claims that Xytex had altered an image of the donor to remove an unsightly mole from his face.

Collins and Hanson are seeking emotional and financial damages, claiming they will be burdened with additional expenses to care for their son, who may have inherited his father’s mental illness.
