Battle Over Midtown Homeless Shelter Entering New Phase

Mayor Kasim Reed will try to use eminent domain to seize the property and evict the shelter and its occupants within four months.

Opponents and supporters of a controversial homeless center in Midtown are digging deeper trenches with the announcement that Atlanta Mayor Kasim Reed is seeking to use eminent domain to seize the structure.

Reed told WSB-TV that he was informed by the CDC that the Peachtree-Pine shelter is the source of a nationwide tuberculosis epidemic, which prompted him to seek to close the shelter. Supporters of the shelter believe Reed is using the outbreak as a ruse to seize the valuable property for developers who want the property.

The courts will have to decide whether the seizure is legal; if it rules in favor of the city, the property must be empty within four months.
