Scheller College Of Business Professor Swire Testifies Before Congress On The Privacy Shield Ruling, Future Of Transatlantic Data Flow

On December 10, Peter Swire, Nancy J. and Lawrence P. Huang Professor of Law and Ethics at the Georgia Tech Scheller College of Business, will testify before the U.S. Senate Committee on Science, Commerce, and Transportation about “The Invalidation of the EU-U.S. Privacy Shield and the Future of Transatlantic Data Flow.” The hearing will examine future policies allowing data flow across geographic boundaries while protecting data exchanges.

Swire has been asked to provide his testimony to the committee regarding the recent Facebook Ireland v. Schrems (II) ruling by the European Union Court of Justice (CJEU). The now struck-down Privacy Shield agreement sought to govern the cross-border data exchange between the U.S. and EU. The ruling states that the agreement doesn’t go far enough to protect EU citizens’ private data or their right to seek legal redress. The United States now faces a significant possibility that the European Union will cut off major online services now offered by the U.S., and otherwise disrupt many other global data flows.
