Commissioners Ask Probate Court To Prepare For Gay Marriage Ruling

Fulton County Commissioners have approved a resolution requesting the Probate Court to prepare for the U.S. Supreme Court’s ruling on marriage equality.

The resolution asks the Fulton County Probate Court to come up with a list of judges who would be willing to officiate marriages for same sex couples, according to The Atlanta Journal-Constitution. The resolution is nonbinding, as the Probate Court does not report to the County Commission.

The resolution passed on Wednesday with a 5-0 vote. Commissioner Bob Ellis did note vote for the resolution because he did not feel comfortable telling other elected officials how to do their jobs and did not want to predict how the high court would rule, the AJC reports.

The Georgia Council on Probate Judges met earlier this year to discuss and prepare for the ruling, which is expected to happen sometime this month. Council president Chase Daughtrey told WABE that if the Supreme Court tosses out Georgia’s ban on gay marriage, local probate judges should comply with the justices’ ruling.
