District Attorney To Charge Girl, 16, As Adult in Craigslist Homicide

The teenager and a 20-year-old man are charged with the murder of a Roswell man who listed his PS4 for sale on Craigslist.

The Fulton County District Attorney said he will pursue charging the 16-year-old girl, one of two suspects arrested for the murder of a Roswell man last week, as an adult.

Paul Howard made the announcement on Tuesday.

“This case has been forwarded to our office for review,” he said in a statement. “After consulting with the Sandy Springs Police Department, we have determined that the suspects in this matter should be prosecuted together. As such, we have decided to seek prosecution against the 16-year-old minor as an adult.”

However, Paul did note an SB440 hearing must be held to determine whether the teenager could be prosecuted as an adult. That hearing has been scheduled for 9:30 a.m. Tuesday, Sept. 23 at the Fulton County Courthouse.

Sandy Springs police arrested the teenager and 20-year-old Nathaniel Vivian and both are facing murder charges in the shooting death of David John Zeitz, 28, of Roswell, who placed his PS4 for sale on Craigslist.

Zeitz was found dead by officers after they responded to a call around 9:30 p.m. Sept. 12 in the 5300 block of Treelodge Parkway.

The Roswell man was found lying on the ground in front of building 5306 with a gunshot wound to the side of his chest, Sandy Springs police spokesperson Sgt. Ron Momon said.

A short time later, Sandy Springs detectives learned that a man — later determined to be Vivian — was being treated at Northside Hospital with a gunshot wound to the hand, Momon stated.

Brookhaven police were at the hospital interviewing Vivian, who Momon said “told them he was a victim of a crime” in their jurisdiction.

However, Momon noted the suspect later told authorities he was shot while he and his girlfriend were at the Legends of Dunwoody Apartments “to rob a man of his PS4 video game system that was advertised on Craigslist.”

The female juvenile, who was at the hospital with Vivian, was taken into custody by Sandy Springs police detectives. Those detectives also found the .25 caliber pistol inside the suspect’s car, which was parked at the hospital. Detectives interviewed the man and teen, and learned they responded to a Craigslist ad for the console and met with Zeitz in the parking lot of 5306 Treelodge Parkway.

“Vivian, who was seating in the driver’s seat of his car, struggled with Zeitz, [who was] standing outside the car, for the PS4,” Momon stated. “During the struggle, the juvenile fired one shot from the .25 caliber gun. The bullet passed through Vivian’s hand and struck Zeitz in the side.”

Detectives also learned that the teenager’s child, about 16 months old, was also in the back seat of the suspect’s car during the robbery and shooting.

The child was later turned over to the teen’s relatives. Both suspects remain behind bars pending their first court appearance.

Funeral services for Zeitz will be held on Saturday at Alpharetta-based King’s Ridge Christian School. A GoFundMe account set up by the school to help the Zeitz family with expenses has raised over $7,000 so far.
