Sandy Springs Imposes 90 Day Moratorium On Sale Of Fireworks

The Sandy Springs City Council at its meeting on Tuesday approved a 90-day moratorium on acceptance of applications for use permits.

Georgia Governor Nathan Deal signed House Bill 110 into law, which “extensively amends” Georgia code pertaining to the regulation of consumer fireworks and fireworks and the role of local governments in regulating and prohibiting the sale and use of consumer fireworks, the city said.

The bill will go into effect July 1.

The Council approved the moratorium on acceptance of any business license application, zoning application, application for sign permits, use permits or other applications involving or addressing the retail sale of consumer fireworks or fireworks.

The moratorium will allow for the consideration and adoption of appropriate zoning ordinances covering the retail sale of such fireworks, since the retail sale of consumer fireworks and fireworks is not currently listed as an approved type of business in the city’s zoning ordinance.

“The change in state law creates a conflict with our city ordinances,” said Sandy Springs Mayor Rusty Paul. “The moratorium provides time to develop and establish appropriate zoning modifications, covering classification and uses related to retail sale of fireworks, and have those changes appropriately adopted.”
