Man Spits In Cop's Face During Arrest: Des Plaines PD

The 24-year-old Des Plaines resident is accused of felony aggravated battery to a peace officer following the incident.

DES PLAINES, IL — A Des Plaines man is accused of spitting in a police officer's face during a recent arrest. Thomas Phlegar, 24, was charged with felony aggravated battery to a peace officer, as well as misdemeanor counts of violation of an order of protection and resisting a peace officer stemming from the May 23 incident.

Phlegar was released following his arrest.

According to police, officers were called to a Des Plaines home where Phlegar had been served an order of protection. Police said Phlegar was highly agitated and told multiple times he was not allowed to be on the property due to the order.

During his subsequent arrest, Phlegar reportedly refused to comply with police and began resisting them when they brought him to the ground. While attempting to secure Phlegar, he spit toward an officer, striking him in the face.

Phlegar was eventually placed into a squad car and transported to the Des Plaines Police station. The Cook County State's Attorney's Office approved the felony charge.
