AURORA, IL — An Aurora resident has been sentenced to a year in federal prison after he head-butted one officer and bit and kicked two others while he was being placed in custody on an arrest warrant last summer, according to the U.S. Attorney's Office of the Northern District of Illinois.
Francisco Javier Acevedo-Caldera, 40, who officials said was in the U.S. illegally, assaulted the three officers the afternoon of July 17 in the lobby of the Kane County Sheriff's Office in St. Charles, officials said.
Two officers from the U.S. Immigration and Customs Enforcement's Enforcement and Removal Operations approached Acevedo-Caldera and informed him they had a warrant for his arrest. Officials said Acevedo-Caldera, who had recently been bonded out of the Kane County jail, resisted the arrest.
The man kicked one officer, head-butted the other and bit a Kane County sheriff's deputy who offered to help, puncturing his skin, according to a news release.
Officials said the officers were "eventually able to subdue" Acevedo-Caldera and execute the warrant.
Acevedo-Caldera pleaded guilty in January to a federal charge of assaulting a federal employee. U.S. District Judge Jeremy C. Daniel sentenced him on May 7 to 12 months in federal prison.
"[The] defendant's conduct was serious — he made physical contact with all three officer victims and caused bodily injury to two of them," Special Assistant U.S. Attorney Sarah Finch said in the government's sentencing memorandum, per the release. "Assaulting these officers in a government building caused risk to public safety and demonstrated disrespect for the law and law enforcement."
