School Sued After Parents Say Boy Kicked In Head During Recess
Three teachers at Immanuel Lutheran School in Batavia are accused of not responding properly.

BATAVIA, IL - The parents of a boy who they say was intentionally kicked in the head by another student while holding a football during recess have sued Immanuel Lutheran Church and School on allegations three teachers did nothing to provide adequate medical treatment or seek help after the 2015 incident, the Daily Herald reports.
The incident in question comes from a report that one student held a football down during recess for the other student to kick it, but the other student kicked him in the head instead. The lawsuit claims that the student whose head was kicked suffered "a severe" blow to the head and a concussion in addition to injuries to his wrist.
The suit was filed in Kane County Court and seeks more than $50,000 in damages, according to the Herald. The three teachers named in the suit are argued to be held responsible for failure to ensure a safe environment.
