Pizzeria Owed More Than $163K In Unpaid Rent: Promenade Bolingbrook

An eviction order was issued against the pizza and burger bar, the Promenade said. The restaurant announced it's closing April 27.

BOLINGBROOK, IL — After complaints from area residents and visitors and "certain public allegations" from Danny's Pizza and Burger Bar, the Promenade Bolingbrook has released a statement sharing that an eviction complaint was filed in August 2024 for Danny's.

"While we typically refrain from addressing legal matters in a public forum, we feel compelled to correct the record due to the spread of one-sided and misleading narratives that we believe are causing harm to the reputation of The Promenade and, most importantly, to its valued tenants," the Promenade Bolingbrook said.

In posts on social media, Danny's Pizza has said the construction on the Promenade Bolingbrook in front of the restaurant dealt a "crushing blow" to the restaurant. The restaurant also said the landlord was not motivated or interested in working with them.

The Promenade Bolingbrook revealed that on March 24, a judge in the Will County Circuit Court ruled in favor of ownership of the shopping center, and an eviction order was issued and judgment was awarded for $163,891.91 against Danny's.

Danny's, which also has a location in Chicago, had not issued a statement on the matter as of Tuesday.

The Promenade Bolingbrook said the judgment amount reflects past-due rent, court costs and attorney's fees. Danny's was also ordered to vacate the premises by May 23.

The business has previously said that its last day at The Promenade will be April 27.

"Notably, this judgment stems from an eviction complaint filed by Ownership in August 2024, more than seven months ago and over a month prior to the start of any construction activities at The Promenade," the Promenade Bolingbrook said.

The Promenade Bolingbrook has also filed a motion to dismiss a lawsuit that Danny's filed against them in January 2025.

"While our motion primarily addresses legal principles, it highlights a critical point: Danny’s was already more than $80,000 in arrears before construction ever began," the Promenade said.

The shopping center added that Danny's has not made a full and timely rent payment since 2023. The restaurant first opened in the Promenade in 2020.

The Promenade Bolingbrook said it works collaboratively with tenants experiencing financial strain, including Danny's. In late 2022, the shopping center said it restructured the lease to support continued operations of the restaurant, which included forgiveness of $200,000 in past-due rent.

"We want the public to know that we understand the significance of The Promenade to the Village of Bolingbrook," the statement reads. "This project is a cornerstone of the community, and we take our stewardship of it seriously. While The Promenade may evolve in the coming years, we are committed to investing millions — if not tens of millions — of dollars into its revitalization."

The Promenade Bolingbrook said this will be the only public statement it makes about Danny's.

"We intend to resolve the remainder of this matter privately and will not be responding to additional comments or inquiries."
