Drunk Man Groped Waitress's Genitalia: Police

A 40-year-old man who had been out drinking to celebrate his birthday woke up in a jail cell after groping a waitress at a Bolingbrook Denny’s located at 126 N.E. Frontage.

According to police, Miguel Garay-Rojas and a 49-year-old friend came into the restaurant highly intoxicated. After being seated at their booth, Garay-Rojas repeatedly asked for the waitress’s phone number and asked her to sit in the booth.

“She stated that she refused to give Miguel her phone number, but did sit at the booth for a short time,” Bolingbrook Lt. Carter Larry said. “She stated that she was trying to humor Miguel and the witness in an effort to calm the intoxicated patrons.”

Garay-Rojas began to rub the waitress’s thigh over her pants and then reached up her pant leg and rubbed her calf and ankle. The waitress didn’t stop Garay-Rojas’ advances, but called police after leaving the table.

Prior to police arriving, the waitress approached the table again, but stood at a distance. Garay-Rojas then lunged toward her and grabbed her apron and pulled her toward him.

“At that time Miguel held on to her apron, ran his hand up her thigh, and rubbed (the waitress’s vagina through her pants,” Larry said.

The waitress told Garay-Rojas “No” and pulled away from him. Garay-Rojas then grabbed her apron a second time and pulled her back toward him, once again rubbing her vagina from the outside of her pants, according to police.

Once police arrived, officers met with the waitress who cried as she pointed toward the two men seated at the table and then walked off into the kitchen. Officers met with Garay-Rojas, who was visibly intoxicated.

Officers also spoke with the 49-year-old man as he exited the bathroom and said he had been out with Garay-Rojas and that he had witnessed him grabbing and rubbing on the waitress. The 49-year-old man would not elaborate on the nature of the contact.

Garay-Rojas was arrested after the victim wished to pursue criminal complaints. He was charged with battery causing bodily harm and criminal sexual abuse.
