A Pet Trust or Pet Protection is a legally enforceable method to provide for the care, maintenance, and well being of your pet when you are unable to care for them whether it is temporary or permanent such as death. Funds are transferred into an account and distributed over the pet’s remaining life. You are also able to select the beneficiaries for any remaining funds and who will be guardian to your pets.
Naming your dog in your Estate Will is not legal in all states and your pets then become property to be dealt with, not cared for.

Attorney Ted Kuczek will talk about the Illinois Pet Trust Act which allows a trust to be created for the care of pets. Some items to be discussed include: who will be the caregiver of the pets; who will be in charge of managing the money for the pet (doesn’t have to be the same person as the caregiver); instructions regarding the standard of living for the pet; how much money to put in the trust; who will receive any money left over when the pet passes away; how to coordinate the pet trust with your own revocable living trust. Since 1984, Ted Kuczek has been in private practice concentrating in estate planning.
