Driver Charged With Fifth DUI In Kane Co. Crash

The crash happened on Oct. 27 at routes 47 and 72 in Pingree Grove, authorities said.

KANE COUNTY, IL -- The Kane County State’s Attorney’s Office has upgraded charges filed against a 38-year-old Plano woman who is now accused of committing her fifth DUI, according to the Daily Herald. Jennifer Agena, of the 3100 block of Hoffman Street, was initially charged with a misdemeanor DUI after she allegedly crashed her 2007 Jeep Liberty at 5:45 p.m. on Oct. 27 at routes 47 and 72 in Pingree Grove. She now faces a felony DUI charge, and a minimum of four years and a max of 15 years in prison, if convicted of her fifth DUI, according to the Daily Herald.

The felony indictment is part of the Kane County State’s Attorney’s Office’s continuing effort to review cases and upgrade charges when needed. In December, Kane County State’s Attorney McMahon told the Daily Herald his office works to be as thorough as they can be when evaluating a defendant’s criminal history and “whether they are eligible for enhanced felony charges.” The comment was not directly related to Agena’s case.

“...When somebody demonstrates they are going to engage in continued drinking and driving, we're going to be aggressive in our response to how we charge those individuals and how we prosecute those cases,” he said.
