Man Guilty In Elgin Home Invasion, Severe Beatings

The victims suffered deep cuts and broken teeth and permanent scarring all over their bodies, prosecutors said.

ELGIN, IL – A 32-year-old Elgin man is the second person to be convicted in a 2012 home invasion where two victims were badly beaten. On Thursday, a Kane County jury found Jamie Zarate, of the 1600 block of Kimberly Avenue in Elgin, guilty of two counts of attempted first-degree murder, a Class X felony, and two counts of home invasion, a class X felony, according to press release from the Kane County State's Attorney's Office. The home invasion occurred during the early morning hours of June 23, 2012.

Zarate, and a co-defendant in the case, Modesto Rosales, 30, also of Elgin, kicked in the front door of a residence in the 400 block of Raymond Street in Elgin. Zarate and Rosales then beat the victims, a male and a female, with their fists, a clothes iron, a computer monitor and a wooden chair, prosecutors said.

The victims suffered very serious injuries, including deep cuts and broken teeth, to the face, head, neck and arms and also suffered permanent scarring all over their bodies as a result of the attack. The female victim was Rosales’ former girlfriend and the male victim was her new boyfriend. Part of the attack was witnessed by the young son of the female victim and Rosales, according to a news release.

Zarate was on parole for a 2006 attempted murder conviction at the time.

Rosales was sentenced on Dec. 5, 2013 to 17 years in prison as part of a plea deal. He entered guilty pleas to charges of home invasion and aggravated battery.

Zarate is next expected in court for a sentencing hearing at 1:30 p.m. on June 7. He faces a minimum of six years in prison.

Zarate had been free on $50,000 bond. Bond was revoked upon conviction and Zarate was taken into custody at the Kane County jail.
