No Charges For Federal Agents In Elgin Pepper-Spray Incident

ELGIN, IL — Federal agents involved in a December immigration enforcement operation in Elgin will not face criminal charges over allegations that protesters were pepper-sprayed during the incident, according to media reports.

Kane County State’s Attorney Jamie Mosser said that while video evidence suggested at least one officer’s conduct may have constituted aggravated battery, federal law prevents state prosecution of agents acting in official duties. The confrontation stemmed from a protest that escalated as agents carried out an arrest, prompting the use of chemical agents and crowd-control munitions, according to the Daily Herald.

Mosser said she hopes the footage will be used for federal review and training on use-of-force tactics, the Daily Herald is reporting.
