Sex Offender Exposes Genitals To Kids At Public Pool: Authorities

The Elgin man also is accused of touching one of the victims with his genitals at Wing Park Pool on Monday.

ELGIN, IL – A 27-year-old Elgin man who is banned from being in public parks because of a 2016 sex offense conviction now faces several additional sex assault charges for allegedly exposing his genitals to multiple victims under the age of 18, including one under the age of 13, at a public pool in Elgin, according to prosecutors. Jose T. Barboza-Lopez also is accused of going so far as to touching one of the victims with his genitals while at Wing Park Pool in Elgin on Monday. Elgin police were called to the pool, at 1030 Wing Avenue in Elgin, around 5:45 p.m. and Barboza-Lopez, of the 700 block of Walnut Avenue in Elgin, has since been charged with aggravated criminal sexual abuse, a class 2 felony; child sex offender in a public park, a class 4 felony; four counts of public indecency, a class A misdemeanor; and two counts of battery, a class A misdemeanor, according to a news release from the Kane County State's Attorney's Office.

Barboza-Lopez, a registered child sex offender, was prohibited by law from being in the pool park with persons younger than 18. In 2016, he was convicted in Cook County of sexual exploitation of a child/sex act when he was 20 and his victim 14, according to online sex offender registry records. He was banned from locations where minors are likely to be present, such as public parks.

He was also on probation for a 2016 burglary offense in Kane County, according to prosecutors.

Barboza-Lopez appeared in bond court Tuesday. His bail has been set at $500,000. If he posts bond, Barboza-Lopez is prohibited from having any contact with anyone younger than 18 years old, according to the news release.

He is next expected in court on July 18.

If convicted of the most serious offense, Barboza-Lopez faces a sentence of between 3 and 7 years in prison, or probation, and he would have to register for life as a sexual offender.
