ELMHURST, IL – A Chicago man is accused of sexually assaulting a woman who believed the man was her Uber driver, authorities said.
Jose Cornelio Evaristo, 42, was charged with two felony counts of criminal sexual assault with the victim unable to give consent and two misdemeanor DUI counts, police said. He is in the DuPage County Jail pending his trial.
About 1 a.m. Thursday, an Elmhurst police officer saw a 2011 Nissan Rogue parked on the shoulder of Route 83, according to a news release from DuPage County prosecutors.
The officer said he saw a man later identified as Evaristo in the front passenger seat facing toward the rear of the vehicle, prosecutors said. As the officer approached on foot, Evaristo got out of the front passenger door with his pants unbuckled and unzipped, police said.
The officer then saw a woman in the front passenger seat, nude from the waist down, who appeared to be asleep, prosecutors said.
After investigating, authorities learned the woman had taken a train to Chicago for a concert. At some point, she ordered an Uber to get home and got into Cornelio Evaristo's vehicle, believing it was the Uber she had ordered, the news release said.
Prosecutors allege Cornelio Evaristo stopped on Route 83 in Elmhurst and sexually assaulted the woman before police arrived. His blood-alcohol level was reported at .08.
"The allegations that Mr. Cornelio Evaristo sexually assaulted a woman who believed he was her Uber driver in the front seat of his car are extremely disturbing and will be met with the full force of the law," DuPage County State's Attorney Robert Berlin said in the news release.
