Elmhurst Bans Possession Of THC Products To Minors

An inadvertent loophole in a federal law allowed minors to buy such products, the city said.

ELMHURST, IL – The Elmhurst City Council this week enacted an ordinance to ban vaping products containing THC from being possessed by those under 21.

Officials said they were targeting sales of Delta 8 and Delta 9 in local convenience and liquor stores. THC is the active ingredient in marijuana.

"You can be 12 and go into a store and walk out with a bag of Delta 8 product," Alderman Mike Brennan said. "We felt it was appropriate to limit the sale of this product to anyone less than 21."

The ordinance took effect immediately, with the city saying retailers were informed about it.

Mayor Scott Levin said other towns are enacting similar measures.

According to a city memo, a 2018 federal farm bill inadvertently created a loophole that allowed minors to buy products with THC.
