Patron Says Bouncer Was Too Rough: LAWSUIT

Owners of Galway Bar and Grill slapped with lawsuit by patron who alleges he was injured by a bouncer in January 2013.

A man is suing the owners of an Elmhurst bar over claims that their bouncer roughed him up for no discernible reason.

Donald Mitchell Nix filed a lawsuit on Jan. 5 in DuPage County Circuit Court against an “unknown employee” and Galway Inn Ltd., which does business as Galway Bar and and Grill at 12045 Roosevelt Road in Elmhurst.

Nix claims that he was a patron at the bar on Jan. 7, 2013 and was behaving in a peaceful and lawful manner. Without provocation, an unknown bar employee acting in the role of a bouncer “grabbed, pushed and struck,” the lawsuit alleges.

The complaint maintains the unknown employee was negligent when he pushed and shoved the plaintiff who was acting in a peaceful manner. The bar owners also breached their duty in properly training and supervising their bouncers by allowing them to wrongly grab, push and strike Nix.

The unknown employee and bar owners should have known such conduct would injure the plaintiff, the lawsuit alleges.

As a result of being roughed up, Nix suffered injuries of permanent nature and incurred medical costs.

The plaintiff is asking damages in excess of $50,000.
