Woman Sues Walmart Over Claims She Was Mowed Down By Shopping Carts

Villa Park store faces lawsuit after woman said she was knocked unconscious when employee pushing long line of carts ran into her.

An Elmhurst woman who claims she was slammed into by a line of carts is suing Wal-Mart Stores Inc.

Joan Baratta filed a lawsuit Nov. 13 in DuPage County Circuit Court for injuries she sustained when she fell in the store’s parking lot at 900 S. Rt. 83 in Villa Park.

According to the complaint, Baratta had finished shopping and was walking back to her car through the parking lot. At the same time, an employee was gathering shopping carts, placing them in a long line and then pushing the line back toward the store.

The plaintiff alleges she was mowed down by the carts, and was knocked unconscious when she fell on the ground. She suffered a concussion, a deep cut in her scalp, a dislocated shoulder, and neck and back injuries, the complaint states.

The lawsuit maintains that Wal-Mart failed to properly train its employees in safely assembling carts in the parking lot and returning the carts to the store. Due to the excessive number of carts joined together, the employee was unable to control the line.

Baratta is asking for $50,000 or more in damages, stating that she continues to incur costs for her medical care and suffers from pain.
