Man Convicted of Frankfort Township Murder Pleads Case to Patch

Brian Trainauskas vehemently denied killing his friend Monica Timar.

A Frankfort Township man found guilty last month of blowing away a female friend with a shotgun vehemently denied the killing in a jailhouse phone call and an email he said he dictated to his fiancee on the outside.

“I should not have been found guilty,” said Brian Trainauskas, 40.

“We proved without a reasonable doubt that I could not have done this,” Trainauskas said of the 2009 murder of Monica Timar.

Whether Trainauskas and his lawyers proved that or not, Will County Judge Dave Carlson still found him guilty last month. Trainauskas is now trying to get a new trial. He also said he is broke and hopes an appellate attorney will step forward to represent him.

In a telephone call and an email he said he dictated to his fiancee, Sarah Volk, Trainauskas made his case for why he should have been found not guilty. The spokesman for the Will County State’s Attorney’s Office, Charles B. Pelkie, disputed Trainauskas’ account.

“All of the issues he writes about were addressed at the trial,” Pelkie said. “What he’s written is completely false. He was convicted of murder and he faces a minimum of 45 years.”

The following is the email sent by Volk, as she said was told to her by Trainauskas. “Those are my words,” Trainauskas said:

“Thank you for the opportunity to be heard. I can no longer sit idly by while the Will County State’s attorney and local media outlets print and propagate malleolus lies, fabricated inaccuracies and fantastic allegations about me. First and foremost, I did NOT kill Monica Tamar nor did I ever harm her in any way shape or form. Monica was a friend of mine who was struggling with severe depression coupled with suicidal ideations.

During my trial several issues were brought to light. Most if, not all, of them where inaccurately portray by the local media or where not printed at all. I feel these issues are paramount for the public to know:

1. The medical examiner found sperm inside her rectum which was not mine. They were able to obtain a sample and attempted to match it to my DNA. Not once, not twice, but three times. Every test returned the same negative results. This sperm was NOT mine. Will County Sheriff chose not to seek a match through CODIS, other witnesses, or any other sexual offender database. Why was this not done? What was Monica, a lesbian doing with sperm inside her rectum? After all these years why hasn’t this DNA been tested against others?

2. Monica had gunshot residue on the back of her hands. I did NOT. Presence of GSR (gunshot residue) proves that she handled/fired a gun.

3. Monica’s girlfriend sent her at least one text message stating, “You promised on your Mom’s soul that you would not kill yourself.”

4. Monica’s girlfriend and her family called in a missing persons report stating that Monica is suicidal and is missing.

5. Monica had access to my house while I was away. The prosecution entered evidence that showed on numerous occasions she had composed emails from my computer.

6. On the day Will County Sheriffs believes she died I was at my fiancé’s house with her and her parents, which cell tower reports verify. During that time someone was at my house using my computer researching suppression of a shot gun.

I have no criminal history or felony background. I have been a Microsoft Certified System Engineer since 1999. In my free time I volunteered at various alcohol and drug rehabilitation centers, I have helped the homeless, and took in unwanted birds two of which were Monica’s. So why in the world would I ever commit this crime? The simple answer… is I did not.”
