Geneva Woman Accused of Poisoning Husband's Smoothie Wants Judge to Set Bail

Julia Guierrez will appear in court Thursday. She is charged with murder for allegedly slipping a sedative into her husband's drink.

GENEVA, IL - A Geneva woman accused of killing her husband after she poisoned his smoothie is now requesting a judge set bail in her case--just weeks after she was taken off suicide watch at the Kane County Jail, the Aurora Beacon-News reports.

Julia Gutierrez’s attorney, Assistant Public Defender Julia Yetter, filed the motion Tuesday, which stated Gutierrez is no longer considered a threat, according to the newspaper. Gutierrez is expected to appear in court in Kane County on Thursday.

Julia L. Gutierrez is charged with first-degree murder in connection with the death of Eduardo Gutierrez whose body was found in their home on Jan. 28.

Julia Gutierrez is accused of mixing Temazepam, which is a sedative used to treat insomnia, into a smoothie and then giving the drink to her husband, according to police and media reports. Eduardo Gutierrez was unaware of the Temazepam, consumed the drink and died as a result, according to a press release from the Kane County State’s Attorney’s Office.
