Kane County Judge Dismisses Lawsuit Filed by Motorist Hit by Ambulance in Geneva
A man sought $50,000 in damages after he was hit by an ambulance while stopped at an intersection in Geneva in 2011.

GENEVA, IL - A Kane County judge dismissed a lawsuit last week filed by a man who said he was injured and missed a month of work after he was rear-ended by an ambulance while stopped at Kirk Road and State Street on Dec. 29, 2011, according to the Kane County Chronicle. Alfredo Garcia claimed the city did not offer him a fair settlement following the crash and he sought more than $50,000 in damages in the lawsuit.
The Kirk Street bridge was covered in black ice when the crash occurred and attorneys for the city argued the ambulance driver and city “are immune from injuries caused by the negligent operation of a motor vehicle when responding to an emergency call.”
