Illinois Gun/Magazine/Registration Bills

The Senate Public Health Committee passed both HB0815 (Large Capacity Magazine & Shooting Range Licensing Bill) and HB1263 (Semi-Automatic Weapons Ban).

The Senate Public Health Committee passed both HB0815 (Large Capacity Magazine & Shooting Range Licensing Bill) and HB1263 (Semi-Automatic Weapons Ban). Below is an overview of the bills (There are several amendments that I have not reviewed yet):

HB0815

  • Goes into affect 1/1/2014
  • All Shooting Ranges must be Licensed by the Illinois State Police, exempts private clubs
  • Shooting ranges my continue to purchase large capacity magazine, but must register them and can only rent them for use at the range
  • Nobody can fire a weapon at a range without a FOID card
  • Bans all magazines that hold more than 10 rounds
  • Grandfathered all owners of large capacity magazines
    • Must register magazines with State Police within 90 days
    • Can only transfer to an heir or FFL dealer
  • Must report lost or stolen large capacity magazines within 72 hours of knowledge

  • Goes into affect 7/1/2013
  • All Shooting Ranges must be Licensed by the Illinois State Police, exempts private clubs
  • Shooting ranges my continue to purchase large capacity magazine, but must register them and can only rent them for use at the range
  • Nobody can fire a weapon at a range without a FOID card
  • Grandfathered all owners of current guns
    • Must register banned guns with State Police within 90 days
    • Can only transfer to an heir or FFL dealer
  • Bans semi-automatic weapons [Defined as]
    • .50 caliber rifles, and .50 caliber cartridges.
    • any of the firearms or types, replicas, or duplicates in any caliber of the firearms, known as:
      • Norinco
      • Mitchell
      • Poly Technologies
      • Avtomat Kalashnikovs (all models)
      • Action Arms Israeli Military Industries; UZI and Galil
      • Beretta AR-70 (SC-70)
      • Colt AR-15
      • Fabrique Nationale FN/FAL, FN/LAR, and FNC
      • SWD M-10, M-11, M-11/9, and M-12
      • Steyr AUG
      • INTRATEC TEC-9, TEC-DC9, and TEC-22
    • any shotgun which contains its ammunition in a revolving cylinder, such as (but not limited the Street Sweeper and Striker 12
    • Semi-automatic rifle or pump-action rifle that can accept a detachable magazine or the following:
      • folding or telescoping stock
      • pistol grip or thumbhole stock
      • shroud that is attached to, or partially or completely encircles the barrel
    • Semi-automatic pistol that has an ability to accept a detachable magazine and has any of the following:
      • folding, telescopingor thumbhole stock
      • shroud that is attached to, or partially or completely encircles the barrel
      • ammunition magazine that attaches to the pistol outside of the pistol grip
      • manufactured weight of 50 ounces or more  when the pistol is unloaded
    • Semi-automatic version of an automatic firearm
    • Semi-automatic rifle or pistol with a fixed magazine that has the capacity to accept more than 10 rounds of ammunition
    • semi-automatic rifle or a pistol with the capacity to accept a detachable magazine, a muzzle brake, or muzzle compensator
    • semi-automatic shotgun with any of the following:
      • folding or telescoping stock
      • a pistol grip or thumbhole stock
      • ability to accept a detachable magazine
      • Fixed magazine capacity in excess of 5 rounds
    • Exempts firearms
      • manually operated by bolt, pump, lever, or slide action
      • inoperable
      • antique
      • rifle with a fixed tubular magazine located under the barrel that is only capable of holding rounds of ammunition placed end to end
      • Air Rifles
      • Olympic Shooting sport rifles
