RE: Conflict of Interest in regards to Resolution 24-27
To the Honorable States Attorney, James Glasgow:

On February 19, 2024, I requested an opinion from your office regarding the two original
documents pertaining to Resolution 24-27. The document received from the State’s Attorney's
office, as the attorney for the County Board, was a non-opinion. In fact, it instructed the elected
officials to act as attorneys and apply the law to the facts as they believed them to be true.

The statement, “It is up to the elected officials to apply the legal principles set forth herein to the factual Circumstances, as they know them to be.”

This statement is unclear and does not help me to protect the integrity of our county government.

Additionally, on February 20, 2024, I requested an opinion outlining the process for the County
Board to hire its own attorney to represent them regarding the obvious conflicting documents
distributed by the County Clerk pertaining to Resolution 24-27. A follow-up conversation with ASA Pyles on February 20, 2024, in the afternoon, and again on February 28, 2024, put the State’s
Attorney's office on notice that the County Board believes there is a conflict for the State’s
Attorney's Office to represent the County Board and the County Executive on this mater. These
conversations also put the State’s Attorney's office on notice that time was of the essence in gettng this process started. As of the writing of this letter I have not received a response from your office.

There is an obvious conflict between the Legislative Branch of government and the Executive
Branch as to which Resolution 24-27 is valid. I am asking the State’s Attorney to acknowledge the
conflict in representing the County Board and the County Executive in this mater and appoint a
Special Assistant State’s Attorney, chosen by the County Board to avoid any additional arguments
regarding conflict, by 4:00 p.m. today.

The Will County Board voted 12 to 9 to stop the 143rd street Expansion Project. The will County executive signed the Resolution. Next the County Executive claims she signed it in error, followed by making another Resolution that did not have her signature on it which she vetoed. Homer Township Sent a notice to stop all work on 143rd St. which was ignored. Homer Township Supervisor Balich immediately held a special meeting to approve the Township taking this to Court, which will be filed early next week. Will County Chair (AKA) Speaker demanded authority to hire an attorney which was denied by the States Attorney. Chair Ogalla has called for a special meeting of the County Board for This Tuesday to address this issue.
