Injured Roofer Sues Joliet Construction Business
The lawsuit was filed this week against Bergeson Construction, a general contractor in Will and Cook Counties.

JOLIET, IL — Bergeson Construction of Joliet is being sued by a roofer who became injured after falling from a job site at the Timbers Edge subdivision in June 2018. The lawsuit, filed on behalf of Gilbert Myers, indicates Bergeson Construction was the general contractor for a series of residential homes built in Joliet at Timbers Edge, which is near Fiday Road.
Myers was a roofer/laborer for RS Home Roofing, a subcontractor at the construction site. His lawsuit indicates Bergeson Construction was in charge of supervising and inspecting the work of the subcontractors and "was under a duty to provide a safe work place for plaintiff and other workers on the construction site."
The lawsuit, filed by attorney Bryan J. O'Connor of Chicago's O'Connor Law Group, indicates that toe boards were required at the residential construction site because of the pitch or angle of the roofs. "On and prior to June 8, 2018," O'Connor argues, "despite being required for worker safety, toe boards were not being used at the job site."

Bergeson Construction did not direct RS Home Roofing to use and install toe boards or take other safety measures "even though it had the power to do so," the lawsuit states.
On June 8, 2018, Myers "while in the course and scope of his work duties for RS Home Roofing ... slid and fell off one of the homes with a steep pitch or angle and sustained serious injury," his lawsuit states. "Toe boards on the roof would have prevented plaintiff's injury."

The lawsuit outlines eight separate instances of negligence by the defendant. The Chicago lawyer has asked a Will County judge and jury to issue a judgment in excess of $50,000 against Bergeson Construction, plus the costs of bringing the lawsuit forward.
Lawyers for the defendant have yet to file their response to the lawsuit.
