Jewel Sued By 2017 Larkin Ave. Customer

This lawsuit got filed last week at the Will County Courthouse.

JOLIET, IL - A woman who visited the Jewel store on Joliet's Larkin Avenue two years ago this month has gone ahead and filed a civil lawsuit against the popular grocery store. Debra Kontol retained the Highland, Indiana firm of Malloy, Etzler & Lawhead to file the lawsuit at the Will County Courthouse. The lawsuit stems from Kontol's customer experience on Jan. 27, 2017.

According to the plaintiff's lawyer, Steven Etzler, "defendant Jewel Food Stores ... had a duty to warn plaintiff of any and all hazardous/defective conditions of which it had or should have had knowledge existed on the premises .... Jewel Food Stores breached these duties by failing to remove defects and failing to warn plaintiff of the cracked/defective asphalt in the parking lot/entryway," the lawsuit states.

The lawsuit states that Debra Kontol suffered personal injuries "to her face, left hand, back and neck ... As a direct and proximate result of the negligence of the defendant, Jewel Food Stores ... Debra Kontol has incurred loss of life's enjoyments. Wherefore, the plaintiff, Debra Kontol, prays for a judgment against the defendant, Jewel Food Stores, in an amount commensurate with the evidence, for costs here under expended, attorney's fees and for all other just and proper relief," her lawyer has asked Will County's judicial system.
