Louis' Restaurant Sued By Delivery Driver Over Grease

The lawsuit was mistakenly filed in Cook County. Now, it's moved to Will County's Courthouse where proper jurisdiction belongs.

JOLIET, IL — A U.S. Foods delivery driver has filed a civil lawsuit against a well-known Joliet restaurant on West Jefferson Street. The lawsuit against Louis' Family Restaurant accuses the business and its employees of negligence. Plaintiff Brett Curlin got injured while delivering six cases of cooking oil down a flight of stairs to the basement on Aug. 31, 2018, according to the lawsuit. Curlin is represented by Chicago attorney Matthew Leonard of Leonard Law Group.

"On August 31, 2018, Curlin, with six cases of cooking oil on his two-wheeler dolly, placed his right foot on the top landing of the stairs, wheeled the dolly down two or three stairs and in the process of stepping with his right foot off on the top landing onto the first stair, lost his balance when his right foot slipped on grease that had accumulated on the top landing of the stairs," the lawsuit states.

According to the plaintiff's lawyer, "when Curlin lost his balance he let go of the dolly to catch himself and in doing so twisted his right knee inward."

The plaintiffs argue, "it was the duty of Louis'... to exercise reasonable care to see hat the aforementioned premises was reasonably safe for those lawfully upon the premises, including Curlin. This duty included maintaining, monitoring, repairing, fixing and otherwise keeping the basement stairs and landing areas of the premises in safe condition.

"Louis' ... should have known of the dangerous condition, namely the grease buildup on the landing," attorney Leonard contends.

The plaintiff and his lawyer want Will County's judicial system to award them "in an amount in excess of the jurisdictional minimum of $50,000,"court records indicate.

"Plaintiff demands a jury trial," the lawsuit declares.
