Medical and Ethical Decisions for Incapacitated Persons - Planning, Protection and Independence

Explore issues facing incapacitated persons in the health care environment, with a focus on how medical decisions are made when patients cannot act for themselves, how planning can protect against delay and confusion, and how a balance between independence and autonomy can enhance one’s quality of life when mental capacity is diminished. The presentation will include an overview of decision making by surrogates under the Illinois Health Care Surrogate Act, by agents under the Illinois Power of Attorney Act, and by guardians under the Illinois Probate Act, as well as special issues relating to protected records and information under the Health Insurance Portability and Accountability Act (HIPAA).
