Villages Reach Agreement Over Properties at Quentin, Route 22

Agreement settles ongoing annexation battle.

The village of Lake Zurich's ongoing legal battle with Hawthorn Woods and Kildeer over the has reached its conclusion.

All three villages' trustees voted unanimously last week on a revenue-sharing agreement for the parcels in question. Per the agreement, the Cedar Hill and Cummings properties will be annexed into Lake Zurich, while Hawthorn Woods will keep the Dartmoor property.

Lake Zurich will keep all of the property tax revenues for the Cummings property, while Hawthorn Woods will keep the property tax revenues for the Dartmoor property. Lake Zurich and Kildeer will receive 75 and 25 percent, respectively, of the property taxes generated by the Cedar Hill property.

The sales tax revenues will be shared as follows:

  • Cedar Hill property: All sales taxes will be paid to Lake Zurich. Lake Zurich will receive 40 percent, Hawthorn Woods 20 percent and Kildeer 40 percent.
  • Cummings property: All sales taxes will be paid to Lake Zurich. Lake Zurich will receive 50 percent, Hawthorn Woods 10 percent and Kildeer 40 percent.
  • Dartmoor property: All sales taxes will be paid to Hawthorn Woods. Lake Zurich will receive 25 percent, while Hawthorn Woods will receive 75 percent of the revenues. Kildeer will receive no sales tax dollars from this property.

β€œWe’ve been trying to get something settled for some time; there were legal time restraints that were getting tight to come to a decision as communities. We decided to approach it from a regional economic standpoint,” said Pam Newton, chief operation officer for Hawthorn Woods. β€œWe wanted to move forward and find some consensus, and we needed a win-win-win for everyone. I think we found that.

β€œWe start the new year without litigation with our neighbor, and we will now begin to share revenues,” said Newton. β€œAlso, we are hopeful this produces a more tranquil relationship moving forward. We have a stronger economic region now. We stopped thinking locally and started thinking regionally, and it will be better off so we don’t lose out with future developers and businesses that want to locate in the area.”

The village of Lake Zurich was set to hold a public hearing Oct. 3 regarding the possible forcible annexation of 53 acres of property at Quentin Road and Route 22. The hearing and the trustees' vote never occurred, however, because a . The judge said Hawthorn Woods began its forcible annexation process first. The same judge had issued a preliminary injunction Aug. 5 to stop Hawthorn Woods from annexing the properties in question.
