School Districts Sue Village Over Impact Fees
The school boards of Fremont Elementary District 79 and Mundelein High School District filed the lawsuit against the village of Mundelein.
The school boards of Fremont Elementary District 79 and Mundelein High School District 120 have jointly filed a lawsuit in Lake County Circuit Court against the village of Mundelein over how it charges impact fees on new residential development.
They argue the fee formula used for the planned Walnut Ridge subdivision doesn’t accurately reflect the true cost of educating the roughly 167 new students expected, leaving the districts short by millions, according to the Daily Herald. The complaint also contends the village approved fees on land without an actual development plan, making it impossible to calculate the financial impact on schools.
The village maintains its fee ordinance follows state law.

“The concerns of both school districts have been heard repeatedly in multiple public forums; the village just disagrees with the schools’ conclusions,” Village Administrator Eric Guenther said in a statement.
