Appeal Goes Against Wieners Circle in Suit Over Woman's Broken Arm

Woman claims hostile atmosphere at Lincoln Park favorite caused her injury in 2011.

CHICAGO, IL - An appellate court overturned a Cook County Circuit Court decision this week in favor of an iconic Chicago eatery against a woman who sued them.

A three-justice panel of the First District Appellate Court ruled in favor of Leah Libolt, who broke her arm outside the Wieners Circle in Lincoln Park five years ago and claimed the restaurant was responsible due to the snarky back-and-forth banter between employees and customers, according to The Cook County Record.

The matter will now head back to the lower court.

The Wieners Circle at 2622 N. Clark St. is known for its edge. Open until 5 a.m., it’s often the site of unruly behavior and trash talk between employees and customers, 75 of which come in drunk during the late night hours according to one employee’s testimony.

But Libolt said it is that “hostile, volatile environment” that led to her breaking her arm outside the spot in 2011. Liebolt alleges the night of her injury that an employe waved a large spoon at a man who then fell into her.

She says the eatery should do more to protect her and other customers.
